someone is claiming spax as their own!

this guy is using spax as a template to create his own pack, without permission, and some unfinished textures are still showing up as spax. I tried to bring it up, but was given a warning on the minecraft forums, due to this thief being a premium member. Just thought you should know.

He's not passing it off as his own. He even admits in about post 6 that it's based off of Sphax.

The thing is his is almost photo-realistic, but Sphax's license states No Derivatives (i.e. building upon the Sphax pack).

I'll make Sphax aware. If he wishes to take any action it will be up to him.

Thank you, I was quickly hushed and my post was deleted. I made no argument other than the striking similarity to spax, and this person's blurb at the top of the post referring to "repercussions if his work was stolen" ha ha...

As far as he doesn't release the textures of PureBDcraft, it's ok with me... However, it would have been "fair" to add some credits... but well, that doesn't matter.

Wait... you got a warning just because he was a premium member even though he is potentially stealing someone else's work... Oh well it is probably to keep the money coming in... Seen things like this on Reddit as well... Yes I'm looking at you League of Legends Sub-Reddit.

Minecraft forums are notorious for shutting down post/threads that they just don't philosophically agree with, whether the content is valid or not...

From what it looks like he IS currently distributing the pack and it still does contain Sphax textures as the pack is still WIP. I haven't downloaded to confirm ... I am very suspect of his license as it over-reaches his legal capabilities, especially in the fair use department (no mix packs mainly, which makes sense as far as YouTube and other public displays goes, he has full control over that, but legally he has no right to limit what I the user can mess with at home, as long as I myself do not distribute or publicly display the results) Then, of course, since his work is a derivative of Sphax's work he should have released it under the same license (and asked permission :p)

*le sigh* people and companies really need to stop mixing up what a consumer can/can't do legally and what a consumer can/can't do and still receive support/warranty from said person/company. I would fully expect that if I mixed two texture packs and it blew up my computer that I would receive no warranty or support from either party, granted if it blew up my computer, I would try to salvage the hard drive to scan for a virus in the suspect texture packs so I could sue the hell out of whomever was responsible (as there really shouldn't be any explosive properties in texture packs ... well then again there are the creepers)

Looking at the texture pack now... It's derived, but it really is no where near the sphax style... Those textures are adequately different that you wouldn't look at them and immediately think sphax. As far as distribution of the base pack, that's not true at all. I just downloaded his patch and there are only his textures there.

To be honest, I don't think this qualifies (even in the least) as plagiarism. I actually quite like his textures, since it adds a more realistic feel to minecraft.
