I've inspected Nam313ssPony's inde patches for the mod... they don't have consistent texture sets in them. Meaning the textures at lower resolutions are more complete than the higher. Please, start from the top then move to the bottom when creating textures. Scaling textures up without significant loss of quality is too difficult or impossible. It's the reason we have 512x for master textures rather than 16x, or at least, I do that.

Also, the file structure is still slightly fubar. Please fix.

I'll possibly be able to help with this much later after I build the bulk of my mod pack patch for DNS, but no promises. I'm taking my texturing exploits slow so I don't get flooded and burnt out.

I do plan to finally update this at least once more now that I have a proper copy of the mod and updated minecraft. Though I doubt I can keep up with it because I've been so busy.

I'm guessing the "base texture" is the hay, snow,grass? Sorry I thought that crediting them was ok, I must of either misread or missed that section.

Because of the way the overlay works, how can I make it use BDCraft textures without including it in the texture pack? (because otherwise it will use the default original minecraft textures, unless something has changed since the last time i worked on this.)

As it states clearly in FAQ you HAVE to ask sphax and gets his permission which will be relayed to a Mod such as the mighty Hanfox who will then make sure your post of the original textures is valid.
I think I got that right because thats the only way I can see it working.

Oh I read the texture use again and saw it there, and if i read it correctly, if I use the original textures as a base, then it's ok.
I just checked the mod file again, it looks like It no longer uses the top overlay textures and pulls directly from the main textures being used. Correct me if i'm wrong, the problem was ONLY the full grass, hay, and snow textures and not others I had used and modified?

There's alot of changes I just realized, so i'm going to release a version with the current textures I have done, then will work on updating other textures after that.

You can use the textures as a base i.e. to build on top of or to design other textures to look similar to what is in the main pack.

You can not use any of the textures from the main PureBD or GrungeBD texturepacks entirely unaltered (e.g. hay, snow and grass)

Sphax never gives permission for Minecraft mod patchers to reuse his textures unaltered. He will generally only give permission for his textures to be used for projects or other games if it the delivery method of the product is free/non-commercial.

@LightHero So very true, he's got an army of textures that, if he didn't maintain, would just fall by the wayside lol.
